They were filming children without their consent as an authority figure and they argued it wasn't "inherently sexual". The fact that someone can do something I would think is obviously immoral and illegal then make such a case without being laughed out of the court is much different than what people instinctively think is "illegal". It's why people got so angry about cuties (the movie).
