One can argue many things. You could also argue that all miners are MSBs that require licenses too.

The cat is out of the bag. The enforceability of anything outlawing Bitcoin or lightning nodes isn't going to happen reasonably. And if it does happen, what are we all even here for in the first place? We should all be expecting unreasonable things like that to take place. We spend a lot of time doing things in the way that we do so that we are the least impacted by custodian or MSB based laws. It's not easy, you get a ton more users by disregarding the law completely, but for us, we're on a stable foundation.

I understand the distinction better for your first question. No, if some LSPs go as far as requiring a new KYC based protocol for channel opens, we wouldn't interface with them. But we wouldn't remove LSP support, like I said any node can be an LSP. It's on it's way to being a spec as much as lightning protocol development is anyways. Any node will be able to be an LSP.
