"Consent or pay" is already common place, in the context of discounts offered to people who subscribe to direct marketing or take a loyalty card.
Someone can either consent to direct marketing / a loyalty card and get a lower price, or not consent and pay a higher price.
I doubt that the ICO will have the appetite to unpick this existing mess, and, IMHO, "consent or pay" in the context of supermarket loyalty cards is egregious enough to demand intervention (but that hasn't happened).
