Compelling providers to intercept messages and take action based on content? Wow that's a slippery slope...
I've seen some high level arguments that "group" messaging is neither private nor personal, or that, above a certain number of participants, or otherwise "unconnected" participants, different rules should apply. I've yet to see anything cogent written about it though.
