Quite frankly, it's a misuse of the word 'imminent.' The court is obviously taking it to mean that there is the knowledge of action that is ready to precipitate, and the use of dangerous speech to make that action break out.
Imminent action can just as easily mean a general climate in which there is the probability of violent action arising, its specific nature unforeseen.
The law, interpreted the way it is, gives stochastic terrorists all the cover they need. And lone wolves can proceed without the fear of accusations of conspiratorial intent with the speaker. Pursuing hate crime statutes is as close as one can come.
