No mention of chromosomes seem intentional and correct and avoids having to cover a lot of edge cases.

(e) “Male” means a person belonging, at conception, to the sex that produces the small reproductive cell.

It uses "conception", which may run into problems (we generally don't observe zygotes...some Turner syndrome women may be XY at conception etc.)....but if you are going to keep things short, I can't imagine a way to avoid some edge cases....this seems like a very very thoughtful writing that considered this.
