There are plenty of reasons to be skeptical of this company's claims here (it smells like a marketing stunt), but let's put that aside for a moment and and assume they're actually doing what they say.

Whether this is "wiretapping" (under either the US law our our intuition) depends a LOT on the technical architecture and implementation. Is "communication content" on which you have a "reasonable expectation of privacy" being "intercepted"? Maybe, maybe not...
