BREAKING: The International Court of Justice (ICJ) has ruled in favor of immediately implementing provisional measures in the landmark genocide case South Africa has brought against Israel. However: there was no provisional measure ordering any kind of ceasefire.
Israel has been ordered to take all measures possible to prevent genocide. They must ensure their forces do not commit genocide. They must punish those who incite and commit genocide and acts of murder against civilians. They must do everything they can to improve the humanitarian situation in Gaza. They must not destroy evidence relating to the genocide case brought by South Africa. The judge stressed the urgency of the situation, and says Israel must report back to the ICJ within a month regarding these provisional measures.Â
Here’s what you need to know:
- The ICJ confirms they have jurisdiction to make a ruling in this case
- There is sufficient evidence that the dispute in this case exists
- Israel’s request to throw out the genocide case was denied
- The ICJ rules that Palestinians are a protected group as defined by the Genocide Convention and their right to be protected from genocide is recognized by the court
- Judge Donoghue states Israel’s military actions led to over 25,000 civilian deaths, over 60,000 injuries, massive destruction of homes, forced displacement of the majority of Gaza, and extensive damage to civilian infrastructure
- UN testimony from on the ground was repeatedly quoted and cited, including UN official Martin Griffiths saying “Gaza has become a place of death and despair.”
- The ICJ quoted multiple examples of dehumanizing language against Palestinians from high ranking Israeli officials such as Israeli Defense Minister Yoav Gallant ordering a “complete siege” of Gaza and telling troops they are fighting “human animals’’ and President Isaac Herzog saying, “it’s an entire nation out there that is responsible
- The ICJ noted that Israel ordered civilians to flee their homes to specific areas and then bombed those areas
- The ICJ added that all Israeli hostages must be released immediately and without conditions
