Amarte is suing retailers offering Marc Jacobs EYE-CONIC eye shadow palettes after previously suing Marc Jacobs itself in Amarte v. Kendo, No. 3-22 cv 8958 (NDCA Dec. 12, 2022). I'm not sure I would have included this image as their evidence of the "substantial similarly" of the marks considering they look nothing alike and no sane customer would be confused considering they are two completely different products?
