Sadly it's not that easy.
Empty blocks are valid blocks.
Blocks that exclude spicy transactions are valid blocks.
Blocks that orphan other blocks that include spicy transactions are valid.
Non-mining nodes could detect censorship and treat censoring blocks as invalid but how would they know if it's censorship? They could require spicy transactions to be present? How would they detect if censoring miners started censoring one kind of spicy but not another?
Bitcoin doesn't work if there is not a majority of honest miners.
I think, the only viable way is to call out miners that mine for censoring pools and drive people to mine with pools that are not enemies of the values of Bitcoin.
