The probability of Donald Trump being sentenced to jail even after he was convicted of 34 felonies in New York is near zero. Any sentence short of jail time will be used by Mr. Trump to mock the system of justice at political rallies and on Truth Social.
However, there is one sentence that would undercut Trump’s ability to spread disinformation without hampering his free speech rights. It also would address Mr. Trump’s deficiencies as a candidate and a low-information American citizen, while promoting his
