And what about trusting the DM to ensure you have a good time? Or a terrible time, depending on the style he runs or you want to play? So many problems with 3.5e for newer players are DM controllable. Adding complexity back in as a set of homebrew rules is much harder than just saying "We don't worry about that for this game."
And if your friend's a rules lawyer, you punch him in the dick. So it's another easy fix.
