In either case, the way they have been handling it so far (e.g. not revealing the cause of faults to the transport authorities which requested them, neither before nor after your revelations) seems to be a valid premise to believe that they knew about everything.
(I expect that their management procured some muddled documents which ought to "explain" to the judge in a completely non-comprehensible way what the causes of failures were, and that they will be dodging further explanations, at least in public, hiding themselves behind 'security reasons')
