Foucault is also on the record saying that sexuality should never be criminalized, because criminalizing rape is “sexually repressive.” This is the core of "queer theory."
In 1977 and 1979, several petitions were signed by a number of prominent French intellectuals, such as Michel Foucault calling for reforms to or the abolition of the French age-of-consent law. A January 1977 petition published in Le Monde criticized the Affaire de Versailles —the detention of three men arrested for sex offences against children aged 12–13. A May 1977 petition addressed at the French Parliament called for the equalization of homosexual and heterosexual ages of consent to age 15. A 1979 petition published in Libération defended a man arrested for sexual relations with girls aged 6–12.
Michel Foucault argued that it is intolerable to assume that a minor is incapable of giving meaningful consent to sexual relations. Foucault also believed consent, as a concept, was a "contractual notion", and that it was not a sufficient measure of whether harm was being conducted.
Foucault called an instance of child rape “inconsequential bucolic pleasures.”
In The History of Sexuality Volume 1: An Introduction he refers to what feminists would regard as an instance of child sexual abuse as ‘these inconsequential bucolic pleasures’ (1981:33).
Queer Theory is basically about normalizing men’s sexual use of children hidden behind throwing off prudish Victorian, “sexual repression.”
In an interview with Guy Hocquenghem, Michel Foucault spoke in defense of child pornogaphy and child sex :
“When someone says that child pornography is the most terrible of present scandals, one cannot but be struck by the disproportion between this - child pornography, which is not even prostitution - and everything that is happening in the world today- what the black population has to put up with in the United States, for instance. This whole campaign about pornography, about prostitution, about all those social phenomena - which are in any case controversial - only leads to one fundamental presupposition: 'it's worse when children are consenting and worse still if it is neither pornographic nor paid for', etc. In other words, the entire criminalizing context serves only to bring out the kernel of the accusation: you want to make love with consenting children. It serves only to stress the traditional prohibition and to stress in a new way, with new arguments, the traditional prohibition against sexual relations without violence, without money, without any form of prostitution, that may take place between adults and minors. “
“In any case, an age barrier laid down by law does not have much sense. Again, the child may be trusted to say whether or not he was subjected to violence. “
