But when it is unjust, that smarts.

And even when it is unjust, ultimately, it impacts the cost of doing business and therefore costs customers more.

But every unjust case going to ADR costs "industry" and that ends up costing customers.

Far better to have a fair system in the first place, surely? Loser pays (small sum for process) is "fair", surely?

Alternative is everybody pays?
