Impeachment request against Alexandre de Moraes proposes seizure of the minister's cell phone

Last Monday (09), opposition members of parliament filed a new impeachment request against Minister Alexandre de Moraes, of the Federal Supreme Court (STF). The action includes an unusual request: the request to search and seize Moraes' personal and functional electronic devices. The proposal aims to collect evidence that could support the accusations made in the document.

The request covers not only Moraes' own equipment, but also that of Judge Airton Vieira, his assistant at the STF, Judge Marco Antônio Vargas, who assisted him at the Superior Electoral Court (TSE), and Eduardo Tagliaferro, an expert who headed the Special Advisory Office for Combating Disinformation (AEED) at the TSE. According to the opposition, breaking the confidentiality of these devices would be crucial to confirm or refute the allegations against the minister.

Challenges and skepticism

Although the impeachment request and the search for evidence have been formalized, many members of parliament believe that the opening of the process is unlikely. This is due to the stance of the president of the Senate, Rodrigo Pacheco (PSD-MG), who needs to give the initial approval for the process to begin. Pacheco is seen as close to Moraes, which generates skepticism among opponents regarding the real chance of the process moving forward.

If the process is accepted by Pacheco, a special committee of senators will be formed to conduct the investigation. This committee would be responsible for analyzing the evidence and deciding whether to continue with the impeachment. The role of this committee is fundamental, since it will be up to it to confirm or dismiss the accusations. The procedure follows the same procedure as other impeachment cases, such as that of former president Dilma Rousseff (PT), in 2016.

The request to seize electronic devices and the consequent breach of confidentiality are justified by opposition members of parliament as essential to the investigation. They argue that access to conversation data, documents and other records stored on the devices of Moraes and others involved could prove the alleged irregularities.

However, legal experts point out that measures like this are extremely serious and rarely applied against members of the Judiciary. In general, the investigation of judges follows more restricted procedures, respecting the separation of powers and the independence of institutions.

The impeachment request against Alexandre de Moraes is not the first. The minister has become a frequent target of criticism from opposition sectors, especially after his work in combating disinformation and institutional violence, as in the cases of the acts of January 8, 2023. His detractors accuse him of overstepping the limits of his role, while his defenders highlight the importance of his firmness in preserving the rule of law.
