To your point on the Server Covenant: it's a great principle and a sound agreement on paper, but a lot messier in practice.
It's not uncommon for situations to happen where a server just isn't accessible anymore: data loss, lack of backups, an admin shutting down suddenly. Many servers are paid for out of pocket, with very little financial support.
