You still need a click-through for that interpretation to work. It would be preposterous for a usage contract/license to be enforceable if the person using the software never got to see it.
But automatic copyright protection *is* universal, and governed by the Berne Convention for the Protection of Literary and Artistic Works.
So ultimately whether a license is a contract or not is irrelevant here. Copyright / "author's rights" / whatever your jurisdiction calls it is automatic. Usage restrictions are not, and are not enforceable if the license/contract is not actually presented to or visible to the user.
