The Lanham Act has a very distinct definition of "counterfeit" though, while the Patent Act does not, so maybe you could be a little hand-wavy with respect to counterfeit embodiments of patents. I think you need a lot more evidence than a bare-bones Schedule A complaint to go from "utility patent infringement" to "counterfeiting." (And "counterfeiting" is meaningless for patent infringement remedies, anyway, as far as I know.)
