It is actually not hard to prove that a surveillance social app has surveillance as its real purpose. A law against this could be passed, and would not violate the first amendment. Hiding surveillance spookery behind the first amendment will not fly with the supremes if it ever gets that far. They have repeatedly ruled that speech or the facilitation of speech or a forum of speech used as a pretext for prurient or unlawful purposes is NOT protected speech.
