But in either case, a lot of folks seem to forget how much a company can be forced to change without being "convicted" of doing anything illegal. As I'm sure you remember, the end of the Microsoft case was the consent decree, not a court ruling. The DOJ doesn't have to definitively win its case to make a huge impact on Apple.
The biggest impacts on Microsoft IMO were attitudinal. They became scared for a long time.
