The plaintiff moved to substitute an expert for one who passed away in January 2022.
The court denied the motion, due to the plaintiff's "utter failure to exercise diligence in confirming in 2022 that Mr. Heiblim would be available for the June 2023 trial" and the plaintiff's "representation to the Court during the September 30 conference that the June trial date 'works for us and our experts.'"
