He also needs discovery for a defamtion lawsuit. What proof exists right now the ADL is lying with malicious intent to harm musk and his business? You can absolutely point to their involvement with other tech firms as evidence to get to the discovery phase. Unless elon has more than just "they damaged" hes gonna have tough time.
