“Israel’s presence in the occupied Palestinian territory unlawful,” says UN’s top court. The ICJ has ruled Israel’s ongoing occupation of the West Bank is illegal.
The non-binding ruling could pave the way for Israeli leaders to be prosecuted at the ICJ.
Article 42 of the 1907 Hague Regulations, pertaining to conduct in warfare, states that “territory is considered occupied when it is actually placed under the authority of the hostile army”.
