Huge areas of East Africa and South Asia do this already, to get around their dysfunctional fiat justice systems. Many of their alternative precedent-based legal systems long-predate the State.
Oddly, the USA does pretty well there too, with high adoption of noncourt alternatives - mediation and arbitration. The USA is, of course, a plutocratic oligarchy, and many arbitration systems are designed to reflect this. But its a lot easier to reform in a competitive decentralized system, and I'm bullish on that system.
