>July 9, 2019: The 2nd U.S. Circuit Court of Appeals ruled in a 3-0 decision that Trump’s blocking of Twitter users is unconstitutional viewpoint-based discrimination. The court held that the President’s Twitter account is a public forum, and blocking users based on their views violates the First Amendment.
>February 11, 2020: The same 2nd U.S. Circuit Court of Appeals reaffirmed its previous ruling in the case of Knight First Amendment Institute v. Donald J. Trump, stating that the President’s blocking of Twitter users is unconstitutional.
>March 15, 2024: The Supreme Court ruled unanimously that public officials, including former President Trump, can be deemed “state actors” when using social media and can therefore face litigation if they block or mute a member of the public.
