The answer: Lincoln. Lincoln invoked the Insurrection Act during the Civil War.

The caveat to this, is that the Supreme Court at the time overruled him, and ruled that suspending Habeas Corpus was unconstitutional.

So what did Lincoln do?

He ignored them.
