LAION and Eleuther.ai don't serve _you_ as infrastructures of "open source development", their job is to be the wedge to enable every commercial entity on the planet to use everything, everywhere for whatever they want without having to abide the licenses.
I think the people involved don't see themselves that way but that's what defines useful fools.
