no, just making vm's with an api is not enough to be a cloud these days, that would make my closet server a cloud and i don't think it is that by far
ec2+ebs+vpc could be a very minimal cloud as it has enough sophistication and features to be somehow useful, but it's quite barebones?
payment model probably doesn't matter, aws wouldn't stop being cloud if you rented some arbitrary quota at a fixed subscription price
