On the other hand, everything Durkin has said so far in this decision about the inadequacy of the plaintiff's allegations and arguments applies to all the defendants, not just the ones who were able to fight back on the record.
If there's not enough to support joinder of these two claims, why allow the rest of the claims to proceed together?
