Not only that, but governments are perfectly happy to knowingly break the law when litigation is the only response, even when judges aren't as off the chain as the current supreme court. Nothing happens to them other than the court telling them to stop, by which time they've got other ways lined up to carry on. Even the uniformly Democratic Party run city government of Los Angeles does this as a matter of policy. They count it as a victory getting through a few years of subverting the law by strategy A until a judge tells them to stop and they have to switch to strategy B, and it is a victory. LAPD has gotten through half a century of reform efforts, including federal oversight, this way with their desired outcomes absolutely unchanged by it.
