UPDATE on the UK based company trying to get our accounts suspended by acquiring old video rights and submitting claims
🚨 What they are doing is in violation of US Law. New owners of copyright content can’t make claims on posts that predate their ownership
- Copyright Ownership and Transfer - 17 U.S.C. § 201: This section of the U.S. Copyright Act establishes that copyright initially belongs to the creator of an original work (17 U.S.C. § 201(a)) and can be transferred via written agreement (17 U.S.C. § 201(d)). If the person bought the rights later, their ownership starts at the date of transfer, not before. The law doesn’t grant retroactive control
- Infringement Timing - 17 U.S.C. § 501:
Infringement occurs when someone violates the exclusive rights of the copyright owner (e.g., reproduction, distribution) at the time of the act. Courts assess infringement based on who held the rights when the alleged violation happened—here, your post. If the claimant didn’t own the copyright then, they wouldn’t have standing to sue for that specific act under this section. (The Ninth Circuit case Silvers v. Sony Pictures (2005) reinforces that only the owner at the time of infringement can claim damages.)
HERE IS THE MAJOR PROBLEM
- To officially challenge these illegal claimants, X requires you to put in all your personal information and a copy of is sent to the original person who made the claim
- This is extremely problematic as it will DOXX anonymous accounts and provide out info to The UK company which is trying to get our accounts banned
EXAMPLE:
- My post was made 1/11/2025. The day the video was taken
- UK Company Newsflare acquired and posted the video 1/13/2025
- They made the claim over a month later but that’s not the problem, the problem is the time they acquired the copyright. It was 2 days after my post
Their claim is illegal.
