I'm part of a team of First Amendment Law Professors that filed an amicus brief supporting TikTok's lawsuit against the ban today.
We argue that the ban obviously targets TikTok because of the content and viewpoint of the speech it carries, and that it's not justified by any of the rationales that have been publicly floated for it, such as an analogy to broadcasting ownership rules or the ill-defined concept of "attention scarcity.”
