An HHS awarding agency may use a rate different from the negotiated rate for a class of Federal awards or a single Federal award only when required by Federal statute or regulation, or when approved by a Federal awarding agency head or delegate based on documented justification as described in paragraph (c)(3) of this section.”

- so the question is about whether this new guidance is in compliance with the above. To me, it doesn’t seem so. While they published a “justification” it seems unlikely to pass scrutiny with the timeline it provides. It doesn’t bode well for future grants even with a court challenge, but I can see the courts maintaining current levels for previously negotiated costs.
