Opti-luxx argues that: "the D930 Design can only have a transparent lens. A device that has an translucent lens does not infringe the D930 Patent. The Opti-Luxx sign has an translucent lens, and accordingly cannot infringe the D930 Patent. Given that the Opti-Luxx sign lacks a transparent lens, there is no legally sufficient evidentiary basis for a reasonable jury to find that the Opti-Luxx sign infringes on the D930 Patent."
