Leaving it on Twitter doesn't hurt his case that much in regards to the merits. He's claimed to do so because the speech at issue isn't criminal. It could still be defamatory. May create one hell of a clusterfuck in terms of damages as they'll likely argue that he could have and should have mitigated those damages by removing the post
