Yeah, it exists, but having it codified and separate from other crime in our legal system creates an incentive for our government to label things as terrorist even when its not. There's too much potential for abuse of power.
But there's an even deeper problem... Charging suspects with multiple crimes for one criminal act. The way it works right now, the dependent gets all of the punishments for all of the different ways that one crime can be labelled, so something which should have had a 10 year prison sentence gets 150 years. That's not how the legal system was supposed to work.
So, adding another charge - terrorism - to that pile just exacerbates the brokenness of the system. And nuance again - I'm not saying criminals shouldn't be punished. We just don't have an actual justice system, while this goes on.
