John Swinney's claim that his government's same-sex facilities guidance does offer exemptions for women has been called into question. The First Minister was grilled about whether he supported the policy which allows trans people access to whatever toilet they want if they self-identify as that gender.
This guidance has been utilised throughout the public sector despite self-identification never being law in Scotland, with attempts to enshrine it in law blocked by the Tory UK Government. It has sparked chaos and concern in recent weeks due to the Sandie Peggie employment tribunal.
Dr Lucy Hunter-Blackburn from the Murray Blackburn Mackenzie policy collective, and a former senior civil servant in the Scottish Government, pointed to an equality impact assessment written by officials on the guidance which claimed that it is “not considered to have a positive or negative impact on eliminating discrimination for men and women.”
She wrote on social media: "The Scottish Government's own policy for facilities in its own buildings is based on self-ID, and takes no interest on the effects on other staff (women staff being the key ones). So this is a pathetic comment from the FM. Won't even own decisions on his own doorstep."
