That can get messy. Not legal advice but generally speaking, unless there's permission or a license, a person using the name could be seen as competing with or misappropriating the mark or the mark. That can create problems even if the original Damus name isn't registered. Lot's of factors like geography, type of use, market, etc. that need to be taken into account.
