2/ I rest my case that we're screwed. Via Steve Vladeck:
Justice Barrett’s recusal makes this grant that much *more* telling (and, to me, ominous).
If the Court splits 4-4, the decision below is affirmed without any opinion. That the justices granted certiorari *despite* Barrett’s recusal suggests that there may well be five votes to side with Oklahoma.
