it is the burden of the legal system and law enforcement to prosecute _the illegal activity_ itself, not the **potential** for illegal activity.
If society swallows the former strategy, then all that the current holders of the reigns of power have to do is say a few magic words ("X can potentially be used for Y") and make any X illegal no matter if Y ever happens.
That is no different than pre-crime/thought-crime.
