🚨 Judge Torres GRANTS the SECs request for Motion for Leave to File an Interlocutory appeal. Here's what we know:
SEC must file its brief in support of its Motion by tomorrow.
The Defendants have until September 1 to file their opposition. And then the SEC can file a reply brief by September 8. After that, its in Judge Torres' hands to determine whether to grant the SEC's request.
To be sure, this does not mean that Torres' intends to grant the SEC's request for interlocutory appeal, and the discretion to do so ultimately resides with her. It does however signal that she is at least receptive to the idea. Moreover, even if she ultimately denies the request, the SEC still retains the right to appeal at the conclusion of trial.
The briefing schedule is quite short, so we should hopefully get an order relatively soon after the briefs have been filed (but that's pure speculation on my part). It's also noteworthy that she did not indicate in this order that she'd be staying the remaining proceedings while she considers the Motion for Appeal, so that suggests to me that she'll want to get an order on the Motion out fairly quickly.
