ns1-33.azure-dns.com
ns2-33.azure-dns.net
...etc. So there's a limited set of name servers available and nothing about the server names that links to an Azure account. You can absolutely create a zone for a domain you don't own and just have it sitting there on Azure's servers, taking up relatively scarce space.
Maybe there are enough servers that Microsoft isn't worried about it.
