now, the "consent" can be manufactured fraudulently by the man/woman not being fully informed of the consequences, for one. this is one reason why, for instance, one can petition to revoke one's SSN, with the claim that it was bequethed without your knowledge as a babe... but you can only do that ONCE - if you re-instate then you cannot relinquish again as you are presumed to know what you are getting into at that point.
there is also the UNALIENABLE aspect to explore here... as the very term indicates that those ingerent Rights cannot be taken away, a lien'ed, loaned, bartered, etc - yet this conflicts with the freedom to contract as one sees fit so thats where a parsing must come in...
but... silence = consent in Law.
