afaik the law is harder if someone is acting not responsible with a weapon than with some thing usually considered harmless.

i manage to hurt u by throwing a piece of paper at you or if i shoot u with a gun

the injuries can be fatal in both cases but the latter is much more grave since the outcome can be expected since a gun is a dangerous weapon.
