While I think it was the right decision and was pleasantly surprised that it was unanimous, I am not at all surprised that the conservative majority reached the right conclusion for the wrong reasons.
I think Slate might be going a bit overboard, though; the insurrection clause has never been invoked, and we don't really know how it's supposed to work. What I'm convinced of is that it was *not* intended to be enforced independently by states. Whether it's on SCOTUS, Congress, the Executive branch, or some combination thereof is another matter. Seems like the kind of thing you'd need "enabling legislation" to clarify if you ask me. Sucks, I know, given the current state of Congress, but the US is doomed anyway so *shrug*.
