For this case, citizenship doesn't matter: as soon as the school accepted tuition money, they made a contract with the students. The fact that there was no intention of ever delivering on that education makes proving breach of contract a slam-dunk.

Note that US law does not restrict contract making to citizens. Otherwise a tourist from Europe would not be legally able to buy anything, groceries included except for cash and for that matter would not be able to buy an airline ticket home. That ticket home requires a contract between the tourist (NOT a citizen) and the airline.

For ICE to sting people attempting to follow the US's own (unjust on stolen land) migration laws also may be a criminal offense. Since they filed criminal charges against the students, this is also entrapment at a bare minimum.
