That's a big issue that unfortunately not a lot of researchers are taking into consideration, especially not the likes of OpenAI, Google, Microsoft, and so on.
But I don't think that makes the entire concept worthless and deserving to be thrown out as a failure. An actual libre model built from donated and public domain works is not impossible.
