I couldn't follow the trust arguments fully. My sense of justice found merit in the contention that if the council owns the hard drive but Mr Howell owns the bitcoin, then the council is holding the bitcoin on trust. The hard drive being the only way of gaining the use of the bitcoin, ie realising the value of this third class of property. For practical purposes, the hard drive is the key. In that sense the bitcoin are 'on the hard drive'. The council are refusing to give him access to his property. That may be reasonable given the location of the drive, but not something that ought to be dismissed out of hand. Although, having said that, the claim comes very late in the day. If, as is no doubt the case, [49] is correct, the claim is time barred
