1. The products are obviously under the same category (snacks that contain nuts)
2. Both brands are knowingly referencing the same joke, and use consumers’ knowledge of the joke in their marketing material.
Also, Dee’s Nuts has been around since 2010, so they can also easily claim that Mr. Beast’s company should have been able to do market research and notice this.
Will they win? Who knows! Mr. Beast has a lot of money to throw around.
